Terms & Conditions of Use (the360life LLC)

1) Notice
These Terms & Conditions (“Terms”) are legally binding. Please read them carefully before purchasing, using, or accessing any of our products, services, content, programs, memberships, or online courses (collectively, the “Offerings”).
2) Agreement to Terms
All Offerings are owned and provided by the360life LLC (“Company,” “we,” “us,” or “our”). “You” or “your” refers to any user, visitor, customer, or purchaser.
By accessing our website(s), purchasing, enrolling in, downloading, or using any Offering, you agree to these Terms and our Privacy Policy (below). If you do not agree, do not use our website or Offerings.
We may update these Terms at any time. Changes are effective when posted, and the “Last Updated” date will be revised.
3) Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase or access our Offerings.
If you are younger than 18 but above the age required to consent to online services where you live, you may not access the Offerings directly. If you are below the applicable age of consent, you may not access the Offerings under any circumstance. If we discover a violation, we may terminate access.
4) Website Use & Assumption of Risk
Use of our website and Offerings is at your own risk. We make reasonable efforts to maintain and operate our site on reputable platforms, but we do not guarantee uninterrupted or error-free access.
5) Purchases, Access, and Consent
When you purchase or opt in to an Offering, you understand and agree that:

6) Intellectual Property
All content, materials, designs, videos, audio, text, graphics, templates, downloads, trademarks, logos, and other materials provided by us are owned by or licensed to the360life LLC (“Intellectual Property”), unless otherwise credited.
You may not use our Intellectual Property in a way that violates these Terms or applicable law.
7) Limited License (Your Permission to Use)
We grant you a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use only, solely for your individual use of the Offering you purchased or opted into.
You may:

Download/print materials for your personal use (and internal business reference, if applicable).

Share brief excerpts with clear credit and a link back to the original source when appropriate (not including paid course materials unless we explicitly authorize it in writing).
You may not:

Share logins or grant access to anyone else (including team members) unless your purchase explicitly allows it.

Re-sell, sublicense, or transfer access to any Offering.

Copy, reproduce, republish, upload, post, transmit, distribute, or exploit any Offering content (in whole or in part) without written permission.

Create derivative works, remix, edit, translate, or adapt Offering content for distribution.

Represent our content as your own.
8) Permissions Requests
If you want to use, reproduce, license, or republish any of our materials, you must request and receive written permission before use.

9) User Content & Communications
If you submit content to us (comments, testimonials, photos, messages, posts, community content, etc.), you represent you have the rights to do so.
Unless prohibited by law, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, and distribute your submitted content as reasonably necessary for business purposes (e.g., community display, support, marketing, or product improvement). If you want limitations on use of a testimonial or image, contact us in writing.
We are not responsible for user-generated content posted by you or others.
10) Community & Acceptable Use
You agree not to use our website or Offerings to:

Violate any law or regulation;

Harass, abuse, defame, or discriminate;

Upload malicious code, scrape content, or attempt unauthorized access;

Post obscene, infringing, or harmful material;

Interfere with the integrity or security of our systems.
We may remove content and/or terminate access for violations.
11) Payment Processing & Security
Payments may be processed by third-party processors (e.g., Stripe, PayPal, SamCart, Kajabi, Shopify, or others). We do not store full payment card numbers. Your payment information is handled by those processors under their terms and policies.
You are responsible for safeguarding your username/password. We are not liable for unauthorized access resulting from your failure to secure your credentials.
12) Disclaimers (Educational/Informational)
Our content and Offerings are provided for educational and informational purposes only and are not medical, legal, financial, or professional advice.
You are responsible for your decisions, actions, and results. Always consult qualified professionals for medical, legal, tax, or financial advice.
13) Earnings Disclaimer
Any testimonials, income examples, or results shared are not guarantees. Results vary based on many factors outside our control, including effort, experience, market conditions, and individual circumstances.
14) Warranty Disclaimer
TO THE FULLEST EXTENT PERMITTED BY LAW, ALL OFFERINGS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the website or Offerings will be uninterrupted, secure, or error-free.
15) Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE360LIFE LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, OR BUSINESS INTERRUPTION.
OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE LESSER OF (A) THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.00.
(Some jurisdictions don’t allow certain limitations; in that case, liability is limited to the maximum extent allowed by law.)
16) Indemnification
You agree to indemnify and hold harmless the360life LLC and its owners, employees, contractors, and affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the website/Offerings, your violation of these Terms, or your infringement of any rights of a third party.
17) Refunds, Payment Plans, Chargebacks (Template Language)
Refunds: Refund eligibility, timeframes, and conditions (if any) will be stated at checkout and/or on the sales page for the specific Offering and are incorporated into these Terms by reference.
Payment Plans: If you choose a payment plan, you agree to complete all payments. Missed payments may result in revoked access and/or collections where permitted by law.
Chargebacks: You agree to contact us first to attempt resolution. If you initiate a chargeback without first attempting resolution, we may revoke access and present evidence to the payment processor.
18) Termination & Revocation of Access
We may terminate or suspend your access to the website or Offerings at any time if we believe you violated these Terms or engaged in misuse. Termination does not eliminate payment obligations.
19) Dispute Resolution
Before filing a legal claim, you agree to make a good-faith effort to resolve disputes informally by contacting us. If unresolved, you agree to attempt mediation or another form of alternative dispute resolution where permitted.
20) Governing Law & Venue
These Terms are governed by the laws of Louisiana without regard to conflict-of-law rules. Any dispute not subject to arbitration/mediation (if applicable) will be brought in the state or federal courts located in United States/Louisiana and you consent to jurisdiction and venue there.
21) Miscellaneous

Severability: If any provision is unenforceable, the remaining provisions remain in effect.

Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement regarding your use.
